This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website www.foxyprofits.com (our site), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please do not use our site.

Our services and our status

Foxy Profits is a portal site giving information and access to services via affiliate links to websites operated by third party merchants (Participating Merchants).

When you enter into a transaction direct with a Participating Merchant, we at Foxy Profits may earn commissions or other remuneration from your transaction, which we will share with you in accordance with these terms and conditions.

If you sign up for any products or services advertised by any Participating Merchant, you acknowledge that the resulting legal contract is between you and that Participating Merchant and is subject to the terms and conditions of that Participating Merchant. You should carefully review their terms and conditions, which will bind you.

We cannot become involved in any dispute between you and a Participating Merchant, since we are not a party to any contract between you and a Participating Merchant.

We cannot give any undertaking that products or services you acquire from any Participating Merchants through our site will be of satisfactory quality and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against any Participating Merchant.

Membership

Our site is only intended for use by people resident in the United Kingdom. We do not accept membership from individuals outside the United Kingdom. We block access to our site from computers outside the United Kingdom.

By registering with us, you warrant that you are at least 18 years of age, you are resident in, and accessing your computer within, the United Kingdom. You must also maintain a valid and subsisting email address to open a Foxy Profits account.

You agree not to register with us more than once, using any identity. We reserve the right to refuse membership and/or terminate membership without notice at any time.

Profit earning

We will share with you between 50% and 75%, as specified in the relevant offer description and/or offer instructions, of any remuneration (whether in the form of cashback, commission, vouchers or otherwise) we receive as a result of us introducing you to a Participating Merchant and you fulfilling any transaction or other conditions specified by the relevant Participating Merchant (your Profit). We will pass on a Profit earned in the form of bingo money credited to your Foxy Bingo account once we have received payment of our entitlement from the Participating Merchant. If you have any queries in relation to any Profit, you should contact us.

You will not be entitled to any Profit if a transaction is cancelled or denied by a Participating Merchant.

You must be logged into your Foxy Profits account and use the links generated by us to accrue Profit.

To be eligible for Profit you must click through direct from the Participating Merchant link provided on our site in the same transaction that you make with that Participating Merchant. Please note that cookie tracking is used to monitor transactions in order to calculate Profit entitlement, so if you subsequently interrupt or remove any tracking cookie in respect of our site or the Participating Merchant’s site your transaction may not be tracked and in such circumstances your entitlement to Profit may not accrue.

Profit accrues when the Participating Merchant confirms your transaction. You acknowledge, however, that it may take some time for the Participating Merchant to transfer any Profit to us. Whilst this occurs usually within 30 days, it sometimes takes in excess of 45 days. We will, however, chase Profits within a reasonable timeframe.

If there are no transactions on your Foxy Profits account for any period exceeding 12 months, we reserve the right to terminate your account and cancel any Profit you have earned.

We use third party software so that transactions concluded between visitors to our site and Participating Merchants are tracked and reported to us. Whilst we take all steps to ensure that all transactions are accurately recorded, we will not be liable for errors in the tracking and validation process beyond our control.

In the event that you cancel a transaction with a Participating Merchant or return any items, any Profit accrued in respect of such transaction will be deducted from your Profit account balance.

If a transaction application is found to be incomplete, fraudulent or otherwise invalid your transaction may be denied and any Profit earned cancelled. In additional we reserve the right to suspend your membership and/or report you to the relevant authorities.

Profit amounts

Our site indicates typical levels of Profits to be obtained via a completed transaction with a Participating Merchant. Whilst we endeavour to ensure that such figures are accurate, you acknowledge that we do not guarantee that the quoted Profit rate at the time of your transaction with a Participating Merchant will be the actual rate paid. Such payments, via a third party Participating Merchant, are outside our control.

Payment of profit

You acknowledge and agree that we shall only be required to pay you Profit when we have received remuneration ourselves from the relevant Participating Merchant. In exceptional circumstances, such as the insolvency of a Participating Merchant, we may receive no payment.

We reserve the right to pay your Profit in the form of bingo money credited to your Foxy Bingo account. This money will act as ‘real’ money and as such can be played and cashed out in the same way as regular deposited money.

Details of your estimated accrued Profit at any time can be accessed for onscreen display. Please note, however, that this does not mean that you will receive that amount of Profit, unless we receive payment from the relevant Participating Merchant(s) and your account has been conducted in accordance with these terms and conditions.

Generally we make payments of Profit once a month, 30 days in arrears, to members who have a minimum Profit account balance of £5 for their first payment and then subsequent payments in multiples of £5. No payments will be made for less than £5, but balances of less than this amount will be rolled forward until the next month.

In order to reduce our administration costs and allow us to pay over more Profit to our members, all payments will be made in multiples of £5.

It is your responsibility to ensure that your username details are accurate and complete. If you give us incorrect username details, we will not be obliged to make any further payment.

We give no guarantee that you will be paid on a set date each month and accept no liability for late or missed payments.

Refer a friend scheme

We operate a separate scheme whereby members can earn additional sums for introducing friends as new users to our website.

Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

When using our site, you must comply with the provisions of our acceptable use policy (see below).

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference, but no further reproduction or copying is permitted in any form whatsoever, whether physical, electronic or otherwise, without our prior consent in writing.

Reliance on information posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

Whilst we use our best endeavours to ensure that any Profit obtainable from a Participating Merchant is correct, we do not guarantee that the rates quoted when you enter into any transaction with a Participating Merchant will be the actual rate paid by the Participating Merchant. You acknowledge that we have no control over the extent of any such amounts and we give no guarantees that you will receive any monetary amounts.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

Acceptable use policy

You may use our site only for lawful purposes. You may not use our site:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm minors in any way;
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our contents standards;
  • to transmit or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

You also agree not to access without authority, interfere with, damage or disrupt:

  • any part of our site;
  • any equipment or network on which our site is stored;
  • any software used in the provision of our site; or
  • any equipment or network or software owned or used by any third party.

Our liability

Any decision to participate in any offer presented on the Foxy Profits website and/or via any Participating Merchant is your sole responsibility and you should read the relevant Participating Merchant’s terms and conditions before participating.

You agree to indemnify and hold Foxy Profits and its employees, officers and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against us arising out of any breach by you of these terms and conditions, or other liabilities arising out of your use of this website, or as a result of us being held to be your agent for any reason.

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Where you enter into a transaction with a Participating Merchant, that Participating Merchant’s liability to you will be as set out in its terms and conditions.

We reserve the right to close your account; and/or amend suspend or terminate the Profit scheme or any part of it and/or restrict availability of the Profit scheme without reference to you and without liability to you.

Information about you and your visits to our site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

Uploading material to our site

Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with the content standards set out in our acceptable use policy (see above). You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.

Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in our acceptable use policy.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Jurisdiction and applicable law

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms and conditions are governed by English law.

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email, or provide you with information by posting notices on our website.
